We think of our business as a profession. Requirements to become a licensed appraiser have increased more than ever before. So it goes without question in this day and age that real estate appraisal can definitely be called a profession rather than a trade. As with any profession we have a strict ethical code.

We have a great deal of obligations as appraisers, but first and foremost we answer to our clients. Typically, for a standard residential appraisal, the lender (or an agent of the lender) places the order to the appraiser, becoming the appraiser's client. Thereon, appraisers have certain duties of confidentiality to their clients, plus strict rules and regulations that must be followed. So, as a homeowner, if you desire to obtain a copy of the appraisal document, you generally have to get it through your lender and not the appraiser.

Other responsibilities include accurate sums appropriate to the scope of the assignment, attaining and sustaining a particular level of competency and education, and the appraiser must conduct him or herself as a professional. Maintaining high ethics is what we do every day at Appraisals By Law.

There are some scenarios in which appraisers will have fiduciary responsibilities to third parties, including homeowners, buyers and sellers, or others. Normally the third parties are clearly defined in the appraisal report. An appraiser's fiduciary duty is restricted to those third parties who the appraiser knows, based on the scope of work or other written parameters of the job.

Appraisers also have duties outside of boundaries of clients and others. For example, appraisers must backup their work files for a minimum of five years - something else Appraisals By Law diligently adheres to.

Working on assignments based on contingency fees is not something we can consider. That is, we are not able to agree to do an appraisal report and collect the fee only if the loan closes. Finally, the Uniform Standards of Professional Appraisal Practice also describes unethical behavior as accepting of an assignment that is contingent on "the reporting of a pre-determined result (e.g., opinion of value)", "a direction in assignment results that favors the cause of the client", or "the amount of a value opinion" as well as other situations. We diligently follow these rules to the letter which means you can be confident we are going above and beyond to objectively determine the home or property value.
